Terms and Conditions (T&Cs) of JANO Lashes (also known as S.EYE.S and Samslashes)
§ 1 Scope and Subject Matter of the Contract
1. These T&Cs apply to all services and product sales between JANO Lashes (also known as S.EYE.S and Samslashes) and the customer.
2. The version of the T&Cs valid at the time of contract conclusion applies. Changes or additions to the T&Cs will be communicated to customers before concluding the contract.
3. Services are only provided to adults with legal capacity. Minors require written consent from their guardians.
§ 2 Offers and Conclusion of the Contract
1. The offers of JANO Lashes are non-binding. Changes to the type, scope, and prices of services remain reserved.
2. A contract is concluded by booking an appointment or purchasing a product and corresponding confirmation by JANO Lashes.
§ 3 Appointment Booking, Cancellation, and Delays
1. Agreed appointments are binding for both parties. Cancellations or rescheduling must be made at least 24 hours before the scheduled appointment.
2. For cancellations within 24 hours before the appointment, 50% of the booked service price will be charged. In the event of a no-show, the full amount will be invoiced.
3. If the appointment is not canceled in time and the customer does not show up, the full price of the service will be charged. If the invoice is not paid within 7 days, a reminder fee of €5 will be added. If payment is not made after the first reminder, JANO Lashes reserves the right to further reminders and legally permissible default interest according to § 288 BGB. The default interest rate is 5 percentage points above the base interest rate for consumers. Further legal action may be taken if the debt remains unpaid.
4. A delay of up to 15 minutes is tolerated. In case of a longer delay, the service may be shortened or canceled to avoid disrupting the subsequent schedule.
5. If an appointment cannot take place due to reasons beyond JANO Lashes’ control (e.g., force majeure), the customer will be informed immediately, and a replacement appointment will be arranged.
6. Customers receive an automatic reminder by email 48 hours before their appointment, with options to reschedule or cancel if needed.
§ 4 Treatments
1. The scope of the treatment is agreed upon individually with the customer in advance. Recommendations by JANO Lashes are non-binding. The customer decides on the treatment.
2. Deviations from the initially discussed outcome are possible, as results depend on individual factors such as hair structure, skin condition, and care habits.
3. JANO Lashes does not accept foreign work (treatments conducted in other studios) for correction. If foreign work is subsequently treated, any guarantee is void.
§ 5 Liability and Risks
1. Before the treatment, the customer is informed in writing about health risks. The customer must provide accurate information about their health, particularly allergies and intolerances.
2. JANO Lashes is only liable for damages caused by gross negligence or intent. Any liability for allergic reactions resulting from insufficient information from the customer is excluded.
3. Customers are asked not to attend appointments if they are ill. A new appointment will be arranged in such cases.
4. JANO Lashes accepts no liability for damages caused by improper aftercare or following treatments by third parties.
§ 6 Warranty and Complaints for Eyelash Extensions
1. A 4-day warranty applies to eyelash extensions. If a significant number of lashes, including natural lashes, fall out within this period, the customer is entitled to a free refill within one week of the original appointment.
2. Complaints are not recognized if:
• care instructions were not followed,
• lashes were treated or altered by third parties or the customer themselves,
• non-recommended care products were used,
• foreign work was undertaken, voiding any guarantee automatically.
§ 7 Care Instructions for Eyelash Extensions, Lifting, and Henna
1. To ensure the longevity of the services, the customer receives relevant care instructions. Following these instructions is necessary for optimal treatment success.
2. The customer is informed about which care products and routines are recommended for the respective treatment.
§ 8 Prices and Payment Terms
1. Current prices for services and products are available on the Samslashes website or in the studio. All prices are in euros, including VAT.
2. Payment is due in cash immediately after the treatment. Credit card payments or payments via PayPal are no longer accepted.
3. Price increases will be announced to customers at least 30 days before they take effect.
§ 9 Vouchers and Special Offers
1. Gift vouchers cannot be exchanged for cash and are subject to the statutory expiration period of 3 years.
2. Special offers and promotions are only valid for the stated period and may be ended without prior notice.
§ 10 Data Protection
1. Responsible: Samanta dos Santos, Hardenbergstraße 53, 51373 Leverkusen, s.eye.s.sam@gmail.com.
2. Collection and Processing of Personal Data: We collect and process personal data such as name, address, phone number, email, and date of birth for appointment scheduling, treatment execution, and contact via phone, email, WhatsApp, Facebook Messenger, or Instagram Direct. These data are stored in a digital and written customer file.
3. Special Data: We process health data (e.g., allergies, chronic illnesses, medication use) as well as photos for treatment analysis and documentation.
4. Disclosure to Third Parties: Data is only shared with web designers, IT staff, image editing software, or cloud services if necessary for providing the services. Appropriate processing agreements exist for this purpose.
5. Data Storage: Data is stored for future treatments unless the customer withdraws consent.
6. Right to Withdraw: Customers can withdraw their consent for data processing at any time by emailing s.eye.s.sam@gmail.com.
7. Data Subject Rights: Customers have the right to access, correct, delete, and restrict the processing of their personal data, as well as the right to data portability and the right to lodge a complaint with a supervisory authority.
8. Data Security: We use technical and organizational measures to protect customers’ personal data against unauthorized access, loss, or misuse.
§ 11 Code of Conduct and House Rules
1. Customers and their companions are expected to behave appropriately while at JANO Lashes. JANO Lashes reserves the right to exclude a customer from treatment in the event of repeated violations of the house rules.
2. If a customer causes damages, JANO Lashes is entitled to claim compensation.
§ 12 Changes to the T&Cs
1. JANO Lashes reserves the right to amend the T&Cs at any time. Changes will be communicated to the customer in a timely manner. The T&Cs valid at the time of booking apply to already scheduled appointments.
2. By continuing to use the services, the customer agrees to the amended terms.
§ 13 Jurisdiction and Applicable Law
1. All legal relationships between the parties are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
2. Jurisdiction is Leverkusen.
§ 14 Severability Clause
Should individual provisions of these T&Cs be or become invalid, the validity of the remaining provisions shall remain unaffected. Instead of the invalid provision, a provision that comes closest to the economic purpose shall apply.
Effective Date of the T&Cs: October 2024
§ 3 Appointment, cancellation and delay
1. Agreed appointments are binding for both parties. Cancellations or rescheduling must be made at least 24 hours before the agreed appointment.
2. If you cancel within 24 hours of the appointment, 50% of the price of the booked service will be charged. If you do not show up without cancelling, the full amount of the treatment will be charged.
3. If the appointment is not cancelled in time and the customer does not show up, the full price of the treatment will be charged. If this invoice is not paid within 7 days, a reminder fee of €5 will be charged. If payment is not made after the first reminder, JANO Lashes reserves the right to claim further reminder levels and the legally permissible default interest in accordance with Section 288 of the German Civil Code. The default interest for consumers is 5 percentage points above the base interest rate. Further legal action may be taken if the claim remains unpaid.
4. A maximum delay of 15 minutes is tolerated. In case of longer delays, the treatment may be shortened or cancelled in order not to affect the subsequent appointment schedule.
5. If an appointment cannot take place for reasons beyond JANO Lashes’ control (e.g. force majeure), the customer will be informed immediately and an alternative appointment will be arranged.
6. Customers will receive an automatic reminder email 48 hours before their appointment. Appointments can be rescheduled or cancelled via this email if necessary.
§ 4 Treatments
1. The extent of the treatment is agreed individually with the customer in advance. Recommendations by JANO Lashes are non-binding. The decision regarding the treatment is made by the customer.
2. Deviations from the originally discussed result are possible, as the result depends on individual factors such as hair structure, skin condition and care habits.
3. JANO Lashes does not accept any third-party work (treatments carried out in other studios) for repair. If third-party work is subsequently reworked, any guarantee becomes void.
§ 5 Liability and Risks
1. Before treatment, the customer will be informed in writing about health risks. The customer must provide truthful information about his or her state of health in advance, particularly about allergies and intolerances.
2. JANO Lashes is only liable for damages caused by gross negligence or intentional behavior. Any liability for allergic reactions caused by insufficient information from the customer is excluded.
3. Customers are asked not to attend appointments if they are ill. In such a case, a new appointment will be arranged.
4. JANO Lashes accepts no liability for damage caused by improper aftercare or third-party treatment.
§ 6 Guarantee and complaints for eyelash extensions
1. Eyelash extensions come with a 4-day guarantee. If a significant number of eyelashes, including your own eyelashes, fall out within this period, the customer is entitled to a free refill within one week of the original appointment.
2. Complaints will not be accepted if:
• the care instructions were not followed,
• the eyelashes have been treated or altered by third parties or the customer themselves,
• care products not recommended by JANO Lashes were used,
• Third-party work has been carried out, which automatically voids the guarantee.
§ 7 Care instructions for eyelash extensions, lifting and henna
1. To ensure that the services last for a long time, the customer receives appropriate care instructions. Compliance with these instructions is a prerequisite for optimal treatment success.
2. The customer will be informed about which care products and routines are recommended for each treatment.
§ 8 Prices and payment conditions
1. The current prices for services and products can be viewed on the Samslashes website or in the studio. All prices are in euros and include VAT.
2. Payment is made in cash immediately after the treatment. Credit card payments or payments via Paypal are no longer accepted.
3. Price increases will be announced to the customer at least 30 days before they come into effect.
§ 9 Vouchers and special offers
1. Gift vouchers cannot be redeemed for cash and are subject to the statutory limitation period of 3 years.
2. Special promotions and offers are only valid for the advertised period and can be terminated without notice.
§ 10 Data Protection

2. Collection and processing of personal data: We collect and process personal data such as name, address, telephone number, email and date of birth for the purpose of making appointments and carrying out treatment as well as for contacting you via telephone, email, WhatsApp, Facebook Messenger or Instagram Direct. This data is stored in a digital and written customer file.
3. Special data: We process health data (e.g. allergies, chronic diseases, medication intake) as well as photographs for the analysis and documentation of treatments.
4. Disclosure to third parties: Data will only be disclosed to web designers, IT staff, image processing software or cloud services if this is necessary for the provision of the services. Appropriate order processing contracts exist for this purpose.
5. Storage of data: The data will be stored for future processing unless the customer revokes his consent.
6. Right of withdrawal: Customers can withdraw their consent to the processing of their personal data at any time by sending an email to s.eye.s.sam@gmail.com.
7. Rights of data subjects: Customers have the right to information, rectification, erasure and restriction of processing of their personal data as well as the right to data portability and the right to lodge a complaint with a supervisory authority.
8. Data security: We use technical and organizational measures to protect our customers’ personal data against unauthorized access, loss or misuse.
§ 11 Rules of Conduct and House Rules
1. The customer and his companions must behave appropriately during their stay at JANO Lashes. In the event of repeated violations of the house rules, JANO Lashes reserves the right to exclude the customer from the treatment.
2. If the customer causes damage, JANO Lashes is entitled to demand compensation.
§ 12 Amendment of the General Terms and Conditions
1. JANO Lashes reserves the right to change the terms and conditions at any time. Changes will be communicated to the customer in good time. For appointments already agreed, the terms and conditions valid at the time of booking apply.
2. By continuing to use the services, the customer agrees to the changed conditions.
§ 13 Place of jurisdiction and applicable law
1. All legal relationships between the parties shall be governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
2. Place of jurisdiction is Leverkusen.
§ 14 Severability Clause
Should individual provisions of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, a provision shall apply that comes as close as possible to the economic purpose.
